SCOTUS hands Trump a victory, allows travel ban to begin


The Supreme Court on Monday partially lifted an injunction on President Donald Trump’s ban on people traveling to the United States from countries rife with Islamic terror and agreed to hear an appeal on lower court rulings that blocked the ban during its fall term.

The decision, a win for the Trump administration, means that people from Iran, Libya, Somalia, Sudan, Syria, and Yemen who cannot demonstrate that they have a reason to travel to the United States will be barred from entering the nation.

Opponents of the ban claim it will prevent people from visiting U.S. family or applying for visas to work or study here. SCOTUS disagreed with those opponents and with the rulings of both the 4th and 9th Circuit Courts, which had blocked the ban on the basis of a possible violation of the Establishment Clause and of the Immigration and Nationality Act, respectively.

Trump’s ban on travel to the U.S. from the six listed countries is of consequence to people falling into only two categories: Those who claim to want to visit the U.S. as tourists but who have no close family in the country and people seeking refugee status.

The ban also is time-limited. For people lacking a “bona fide relationship with a person or entity in the United States,” the  ban bars access for a period of 90 days. For people claiming refugee status, it bars access for a period of 120 days.

SCOTUS noted the self-imposed limitations provided in the travel ban, determining Monday that it “does not burden any American party by reason of that party’s relationship with the foreign national. And the courts below did not conclude that exclusion in such circumstances would impose any legally relevant hardship for the foreign national himself.”

When the court takes up Trump’s case later this year, its focus will be on removing any doubt about the president’s power to limit immigration in response to terror threats.

In its argument against the lower court rulings, the Trump administration claims that the 9th Circuit’s decision “threatens to hamstring the Executive in safeguarding the nation’s border” while the 4th Circuit’s ruling creates uncertainty about presidential power. Chances are good that Trump will score another victory in the fall, when arguments are expected to begin on the case.

Conservative Justices Clarence Thomas, Samuel Alito and Neil Gorsuch, in the Monday decision, said they would have allowed  Trump’s original complete travel bans to take effect, noting that the administration’s interest in national security outweighs any hardship the government might create for foreign nationals wishing to enter the country.

Madigan never going to agree to a deal that includes any actual reforms/Rauner needs not to give in

Illinois Gov. Bruce Rauner won the 2014 gubernatorial election on a 44-point Turnaround Agenda meant to “shake up Springfield.”

Rauner understood Illinoisans’ need for change. They were suffering under the worst jobs recovery in the nation. Homeowners were being squeezed by the nation’s highest property taxes. And pension costs were consuming a quarter of the state budget, crowding out everything from college grants for low-income students to services for the disabled.

Illinoisans voted for Rauner and his agenda to change how government does business, to revive the state economy and to provide relief to taxpayers.

Three years later, things have changed dramatically. Illinoisans still want reform, but repeated budget stalemates, a media narrative that the governor is unwilling to compromise and pressure from special interest groups has whittled down Rauner’s ambitious reform agenda. It’s gone from 44 priorities to zero.

Term limits on politicians: Gone.

Collective bargaining reforms: Gone.

Returning income tax rates to 3 percent: Gone.

And the remaining “reforms” in the compromise plan taking shape in Springfield have been watered down so much they’ll either do nothing to fix state spending or they’ll make things even worse.

The two-pronged pension reform plan fails everyone in Illinois, from state workers and taxpayers to those dependent on social services. Part of the plan will likely be found unconstitutional and waste years of everyone’s time. And the rest perpetuates pension benefits going forward; it’s these unaffordable retirement benefits that got Illinois into this financial mess in the first place.

The proposed workers’ compensation reforms are also marginal and do little to fix the seventh-most expensive system in the nation. These changes would make little difference to struggling businesses.

And the property tax freeze on the table isn’t a freeze at all. It’s filled with so many loopholes it’s essentially worthless. Pension and debt costs are exempted from the freeze. The city of Chicago and its schools are entirely exempted. School districts in financial difficulty are exempted as well. With so many exemptions, taxpayers will still see their bills grow.

There’s nothing left in the compromise plan but a massive, $5 billion a year tax hike.

What Illinoisans want

The long list of concessions Rauner has made run contrary to what Illinoisans want and why he was elected in the first place.

Two-thirds of Illinois voters don’t want an income tax hike as part of the state budget, according to a survey conducted by Fabrizio, Lee & Associates and commissioned by the Illinois Policy Institute.

Eighty percent of survey respondents said they want lawmakers to focus on structural reforms before increasing taxes.

It’s absurd for Illinoisans to have to pay more than $5 billion in new taxes just to get their property taxes frozen at highest-in-the-nation levels. Yet that’s the core of Springfield’s “compromise.”

Back to reforms

Rauner has compromised over and over in an attempt to strike a deal, to the point of abandoning every reform he once sought. But no matter how much Rauner gave, House Speaker Mike Madigan never budged.

But there is a silver lining. It should now be clear to everyone, including Rauner, that Madigan was never going to agree to a deal that included any actual reforms. The last two years have validated that Rauner should not have attempted to compromise in the first place.

Springfield really does need to be shaken up.

At this point, Rauner has only one real option left. He has to return to demanding what Illinoisans actually want: structural changes to how Illinois does business.

That means returning to the original Turnaround Agenda. More importantly, it means championing a budget that balances without tax hikes.

The people of Illinois should be listened to – not the politicians, nor the media nor the special interest groups.

The media is supposed to report only facts and let readers form their own opinion. Editorials and letters to the Editor are the opinion of the writer. It seems wrong for a media outlet to put out news based in unsupported evidence. It is also wrong for news reporting on leaks with no name associated with it. A person leaking information would be willing to give their name unless they are lying or breaking the law with their leak.

When the Wiki Leaks emails came out, no one disputed that they were true. The things said in those emails were true. Wiki leaks said they did not come from Russia or Trump. Media pushing fake Russia story caught in plan to say anything necessary to destroy Trump

Trump takes aim at media after Russia story retraction

President Trump on Tuesday morning called out a host of major print and television outlets, decrying them as “Fake News” and taking particular aim at a familiar media nemesis.

Trump’s tweets came in the aftermath of CNN’s retraction of a story linking a Trump adviser to a Russian investment fund. Three journalists involved in the story’s publication have since resigned and CNN issued an apology to the Trump adviser. But the debacle still caught the president’s attention as he wondered if a similar reckoning awaited other organizations.

“So they caught Fake News CNN cold, but what about NBC, CBS & ABC? What about the failing @nytimes & @washingtonpost? They are all Fake News!” Trump wrote.

Earlier in the day, he focused his outrage directly at CNN, a network whose reporters and bosses Trump has frequently battled.

“Wow, CNN had to retract big story on ‘Russia,’ with 3 employees forced to resign. What about all the other phony stories they do? FAKE NEWS!” Trump wrote.

He added: “Fake News CNN is looking at big management changes now that they got caught falsely pushing their phony Russian stories. Ratings way down!”

Trump also retweeted a graphic done in the style of CNN’s logo but instead depicting the letters “FNN” for “Fake News Network.”

Make federal pensions transparent

Every year, the federal government pays $125 billion in tax dollars for federal pensions. In spite of this being such a large amount of money, there is a remarkable lack of transparency surrounding these funds.

Taxpayers deserve to know the details of the lucrative pensions of career bureaucrats and members of Congress. Basic questions deserve answers: How many years were worked, how much money was paid-in and by whom, how quickly did they break-even on their own contributions, and just how much did the taxpayers finance?

Releasing data on federal pensions will require an act of Congress, and we are leading the way. The Taxpayer Funded Pension Disclosure Act will empower citizens with the data and technologies to hold their government accountable like never before.

Today, pension data is not merely opaque; it is literally hidden in an underground complex in Pennsylvania. Federal employees hand-calculate federal pensions in a process that has not changed since the Cold War era. How many mistakes has the government made in that cavernous complex? No one knows because we’re all in the dark.

The case for greater federal pension transparency can easily be made by looking at the fraud that has already been exposed by non-profit organizations like Open The Books at the state level. In the 32 states that have pension transparency – including California, Illinois, New York and Oregon – citizens have exposed significant amounts of waste and mismanagement.

Auditors at Open the Books uncovered a pair of union bosses in Illinois who taught as substitutes for one day in public schools and then retired, in order to collect a pension that will amount to $1 million dollars over their lifetime.

At the Port Authority of New York and New Jersey, data shows that a police lieutenant with a final salary of $129,000 received a starting pension of $172,000. An assistant airport operations manager retired with a final salary of $89,000, but soon began collecting a $103,000 pension. An electrician quit with a base salary of $76,000 and collected a pension of $79,000.

With relatively little transparency, we’ve found numerous examples of waste and abuse across the country. Consider what we’d find if we could see more at the federal level.

For instance, former IRS chief Lois Lerner used her authority to infringe the rights of American citizens and consistently obstructed congressional investigations. Wouldn’t it be nice to see her pension information? Her pension is estimated to equal nearly $2 million in lifetime payout.

According to the Office of Personnel Management, in 2012, 21,000 retired federal employees were collecting pensions exceeding $100,000. Since then, the number has likely doubled or tripled. Moody’s estimates federal employee pensions have a $3.5 trillion-dollar unfunded liability, with taxpayers on the hook to guarantee it all. All of this information should be posted online in real time.

Revealing this data across the board will allow citizens and policymakers to have a productive debate about pensions. Pulling this data out of the government’s underground pension cave and into the light will protect taxpayers, retirees, and near-retirees who have a right to ensure these taxpayer dollars are well-spent.

As the Trump administration continues to deal with controversy over whether it has improper ties to Russia, some Americans are mistakenly lionizing former FBI Director James Comey.

As The Intercept reminds us:

While Comey is now positioned for history to remember him as the cop who took down Trump, or tried to at great professional expense, there should be wariness about lionizing Comey in the way the news media have in recent days. Under Comey, the FBI pushed investigative and surveillance powers to new and controversial limits and employed tactics that were morally and ethically bankrupt.

In short, Comey’s FBI did some terrible things.

Comey, a huge fan of government overreach, supported the FBI as it carried out some of its biggest assaults on liberty.
